1. Acceptance of Terms

By accessing or using MarketGapAI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

MarketGapAI is a market research intelligence platform that analyzes user complaints and feedback across multiple platforms to identify validated business opportunities. The Service includes AI-powered market analysis, opportunity discovery, and MVP blueprint generation.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Subscription & Billing

  • Paid subscriptions are billed monthly at the rate displayed at the time of purchase.
  • Subscriptions auto-renew unless cancelled before the end of the billing period.
  • You may cancel your subscription at any time through the Manage Subscription portal.
  • All payments are processed securely by Stripe. We do not store your payment card details.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or copy the Service's data or algorithms
  • Share your account credentials with third parties
  • Resell, redistribute, or sublicense the Service or its output without written permission
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated tools to access the Service beyond normal usage patterns

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, algorithms, and software — are the exclusive property of MarketGapAI and are protected by copyright, trademark, and other intellectual property laws.

Analysis results generated for your account are provided for your personal or internal business use only.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that market opportunities identified by the Service will result in business success. All business decisions based on our data are made at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, MarketGapAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, without prior notice. Upon termination, your right to use the Service ceases immediately.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MarketGapAI operates, without regard to conflict of law principles.
